Nederland bekijkt of Europese regelgeving voor drones handig is voor de eilanden

Nederland wil weten of de Caribische eilanden mee kunnen liften op het dronebeleid van de Europese Unie. Op de Caribische eilanden is het vliegen zonder een gezagvoerder aan boord verboden. Drones mogen daar dus niet vliegen.

Het heeft daarom aan adviesbureau Deloitte gevraagd te onderzoeken of het Caribisch gebied moet worden meegenomen in de ontwikkeling van U-space, een verkeersmanagementsysteem voor onbemande luchtvaartuigen in Europa (UTM).

Afhankelijk van de behoefte aan drones en drone diensten kan er worden overwogen om drones wel te faciliteren op de eilanden. Dat kan op verschillende manieren. Indien de verwachting is dat dit een beperkt aantal drones zijn met beperkte risico is het voorstelbaar dat het optuigen van een volledige UTM niet proportioneel is, terwijl als er een groot aantal drones verwacht wordt dit wellicht wel te verantwoorden is.

Implementatie van een UTM is volgens de onderzoekers wellicht een te zwaar middel om drones te faciliteren in het Caribisch gebied. Andere opties dan de implementatie van een UTM passen wellicht beter bij de huidige situatie, zoals de introductie van een ontheffingsmogelijkheid binnen de dronewetgeving.

Met het oog op de toekomst kan het goed zijn om het Caribisch gebied
mee te nemen in de ontwikkeling van de Nederlandse UTM. Verder onderzoek is nodig om hier een definitief antwoord op te geven.

Verantwoording

De verantwoordelijkheid voor wetgeving met betrekking tot drones ligt voor de BES-eilanden bij het ministerie van Infrastructuur en Waterstaat en voor de zelfstandige landen bij deze landen zelf. Desondanks is de betrokkenheid van Curaçao, Aruba en Sint Maarten bij de ontwikkeling van een UTM op de BES-eilanden mogelijk vanwege het belang van samenwerking met de BES-eilanden.

Door eventuele luchtverkeersmanagementsystemen goed op elkaar af te stemmen is het makkelijk om vluchten tussen eilanden uit te voeren. Hierbij valt te denken aan gelijke eisen wat betreft aanwezige technische systemen, gelijke communicatieprotocollen en één vergunning voor een vlucht door het luchtruim van verschillende eilanden. Volgens die gedachte wordt er momenteel bijvoorbeeld ook gewerkt aan een gemeenschappelijke (geharmoniseerde) droneregelgeving voor de zes Caribische eilanden van het Koninkrijk.

Advies

Wanneer wordt gekozen om een UTM te implementeren in het Caribisch gebied dan is harmonisatie met omliggende gebieden van belang om vluchten tussen gebieden te faciliteren. Het volgen van een internationale standaard voor UTM’s zorgt voor aansluiting op wereldwijde technologische ecosystemen van UTM’s en drones, aldus Deloitte.
